The facts we can state:

1. The government got the mayor of Ponce agreed to delete the Memorandum of Understanding signed in 2009, a clause guaranteeing that Ponce did not have to pay the debt of $ 250 million if that the municipality decided to stay with the Port.

2. That's why the gonernador Fortuño announced with great fanfare he was giving the Port of Ponce and ironically called "The Solution Ponceña."

3. central government out of the hot potato-door delivery to Ponce, he knows that because of the change that the mayor allowed in the Memorandum of Understanding 200. Ponce are boxed and have to pay $ 250 million.

Judgement day the parties appear in court with your witnesses and documentary evidence, scientific and demonstrative available.

The party has the burden of proof on the claim, which is usually the plaintiff or prosecution, should start presenting its case to establish the allegations of the complaint or accusation.

At the start of trial, he will be sworn witnesses rigorous and excluded from the room which will not declare at the time so it will not benefit from the previous witnesses testify.

The judge or judge must ensure that witnesses are aware of their obligation to tell the truth and that may be subject to perjury, contempt or otherwise.

The party filing witnesses will be forced, as a rule, direct questioning, one that can not be leading questions. That is, suggesting to the witness the answer that you want the questions.

During this process, witnesses declared only if they are trained for it, if they have personal knowledge of relevant facts and whether their testimony is not inadmissible as a rule of exclusion of evidence, as the Rule of Evidence Reference.

The statement of the person must produce evidence relevant to the case, which is one that tends to make the existence of a fact that has implications for the allocation of the action more probable or less probable than it would be without such evidence, this fact should in turn refer to a matter in dispute in the case to the credibility of a witness or deponent.

During testimony to authenticate, identify or validate documents and scientific or demonstrative evidence (objects) that you wish to be admitted in evidence.

People who testify may be laymen and experts (experts). The rules for presentation varies depending on the nature of the person reporting. For example, if willing, can not state the basis of inferences or opinions certain exceptions. If proficient, his statements will generally be based on inferences or opinions.

The whole process of submission of witness evidence must follow strict rules. These rules are supplemented by the objection process carried out by lawyers and lawyers and as part of the legal battle. -------------------------------------

is now available for sale the third edition of Syllabus Puerto Probation Law (2010) Reporting and contemporary doctrine on The new Rules of Evidence went into effect on January of this year. This was announced Atty. Emmanuelli Rolando Jimenez, author of the publication that discusses in detail the Rules of Evidence, 2010, which determine what happens during the trial in court in Puerto Rico.


The first edition of Syllabus was published in 1994 and was awarded Legal Work of the Year 1995 by the Bar Association of Puerto Rico. The second edition was published in 2005 and included amendments to the Rules of Evidence made until 2004.


The Syllabus Probation Law Puerto is used as a textbook in law schools and universities that offer pre-legal and forensic science in Puerto Rico. Has been listed as well, as an authority on numerous occasions in the Judgments and Opinions of the Courts of First Instance, the Court of Appeals and the Supreme Court of Puerto Rico.


The third edition has 650 pages and contains all the information needed to understand the Law of Evidence in Puerto Rico, particularly the popup with the new Rules of Evidence, 2010.


The book begins with an introduction to the process of drafting and adoption of new Rules of 2010, continuing a definition concepts, together with a report on the judicial process and the practice of law until the time of trial. continues with a brief history of the law of evidence, and sources and the main reasons of the matters in Puerto Rico. Presents the new rules, following the format of the Report of the Standing Advisory Committee on Rules of Evidence Supreme Court as to the origin of each rule, thus establishing the differences with the original 1979. Finally, it addresses the fundamental doctrinal and jurisprudential issues and to promote critical for future improvements.
